APPLICANT: 7520 Worthington Galena Road LLC; c/o Elizabeth A. Seedorf, Atty.; 52 East Gay Street; Columbus, OH 43215.
PROPOSED USE: Unlimited veterinary practice.
CITY DEPARTMENTS' RECOMMENDATION: Approval. The site consists of one parcel developed with a veterinary facility containing veterinary office, veterinary hospital and indoor animal boarding uses in the M-2, Manufacturing District as approved by Ordinance #1491-93 (Council Variance #CV93-040). The requested Council variance will allow the existing facility to expand its allowable uses to include outdoor veterinary treatment, a use that is not allowed in the M-2 district. Variances to reduce a drive aisle width, allow gravel surfaces for a driveway and overflow parking area, reduce the required parking from 23 to 15 spaces, and reduce the parking setback are also included in the request. Staff note the request is supplementing the existing use, which is supported under the “Warehouse Flex” land use recommendation of the Far North Area Plan (2014), and will not add an incompatible use to the area.

To grant a Variance from the provisions of Sections 3367.01, M-2 manufacturing district; 3312.09, Aisle; 3312.43, Improved surface required; 3312.49, Required parking; and 3367.15(d), M-2 manufacturing district special provisions, of the Columbus City Codes; for the property located at 7520 WORTHINGTON-GALENA RD. (43085), to allow unlimited veterinary practice and animal boarding uses with reduced development standards in the M-2, Manufacturing District, and to revoke Ordinance #1491-93 (CV93-040), passed July 12, 1993 (Council Variance #CV25-028).
Body
WHEREAS, by application # CV25-028, the owner of the property at 7520 WORTHINGTON-GALENA RD. (43085), is requesting a Variance to allow unlimited veterinary practice and animal boarding uses with reduced development standards in the M-2, Manufacturing District; and
WHEREAS, Section 3367.01, M-2 manufacturing district, does not allow veterinary office, veterinary hospital, indoor animal boarding, and outdoor veterinary treatment uses, while the applicant proposes to maintain and expand said uses in and around the existing facility; and
WHEREAS, Section 3312.09, Aisle, requires a minimum aisle width and maneuvering area of 20 feet, while the applicant proposes a reduced drive aisle width and maneuvering area of 12.1 feet along the north side of the building to access the eastern side of the property; and
WHEREAS, Section 3312.43, Improved surface required, requires the surface of any parking or loading space, parking lot, aisle, or driveway be designed to control storm water runoff and be improved with Portland cement, or other approved hard surface other than gravel or loose fill, while the applicant proposes gravel surfaces for a driveway along the north side of the building and an overflow parking area around the existing barn located on the eastern side of the property; and
WHEREAS, Section 3312.49, Required parking, requires one space per 300 square feet for medical office; and one space per 1,000 square feet of warehousing; for a total of 23 required parking spaces, while the applicant proposes to provide a total of 15 spaces, with overflow parking available on the gravel surface located on the eastern side of the property; and
WHEREAS, 3367.15(d), M-2, manufacturing district special provisions, requires a minimum 50 foot landscaped parking and building setback, while the applicant proposes parking and maneuvering at 30± feet from Worthington-Galena Road after the required right-of-way dedication of 50 feet from the centerline of Worthington-Galena Road is completed; and
WHEREAS, City Departments recommend approval because the request is supplementing the existing use, which is supported under the “Warehouse Flex” land use recommendation of the Far North Area Plan and will not add an incompatible use to the area; and.
WHEREAS, said ordinance requires separate submission for all applicable permits and a Certificate of Occupancy for the proposed use; and
WHEREAS, said variance will not adversely affect the surrounding property or surrounding neighborhood; and
WHEREAS, the granting of said variance will not impair an adequate supply of light and air to adjacent properties or unreasonably increase the congestion of public streets, or unreasonably diminish or impair established property values within the surrounding area, or otherwise impair the public health, safety, comfort, morals, or welfare of the inhabitants of the City of Columbus; and
WHEREAS, the granting of said variance will alleviate the difficulties encountered by the owners of the property located at 7520 WORTHINGTON-GALENA RD. (43085), in using said property as desired; now, therefore:
BE IT ORDAINED BY THE COUNCIL OF THE CITY OF COLUMBUS:
SECTION 1. That a variance is hereby granted from the provisions of Sections 3367.01, M-2 manufacturing district; 3312.09, Aisle; 3312.43, Improved surface required; 3312.49, Required parking; and 3367.15(d), M-2 manufacturing district special provisions, of the Columbus City Codes; for the property located at 7520 WORTHINGTON-GALENA RD. (43085), insofar as said sections prohibit veterinary office, veterinary hospital, indoor animal boarding, and outdoor veterinary treatment uses in the M-2, Manufacturing District; with a reduced aisle width and maneuvering area from 20 to 12.1 feet along the north side of the building; gravel surfaces for a driveway along the north side of the building and an overflow parking area located on the eastern side of the property; a parking space reduction from 23 required to 15 provided spaces, with overflow parking available on the eastern side of the property; and a reduced parking setback line from 50 feet to 30± feet from Worthington-Galena Road after the required right-of-way dedication is completed; said property being more particularly described as follows:
7520 WORTHINGTON-GALENA RD. (43085), being 0.86± acres located on the east side of Worthington Galena Road; 860± feet northeast of Dearborn Drive and being more particularly described as follows:
Situated in the State of Ohio, County of Franklin, City of Columbus, being in Lot 5 of Smith & Jenkins unrecorded subdivision of Section 1, Township 3, Range 18, United States Military Lands, containing 0.858 acre of land, more or less, said 0.858 being out of that tract of land designated as FIRST TRACT as described in the deeds to Orville E. Keys, of record in Deed Book 1136, Page 268 and Deed Book 1275, Page 7, both being of record in the Recorder's Office, Franklin County, Ohio said 0.858 acre of land being more particularly described as follows:

SECTION 2. That this ordinance is conditioned on and shall remain in effect only for so long as said property is used for unlimited veterinary practice and animal boarding uses, or those uses allowed in the M-2, Manufacturing District.
SECTION 3. That this ordinance is further conditioned upon the applicant obtaining all applicable permits and a Certificate of Occupancy for the proposed use.
SECTION 4. That Ordinance #1491-93 (CV93-040), passed July 12, 1993, be and is hereby revoked.
SECTION 5. That this ordinance shall take effect and be in force from and after the earliest period allowed by law.
