Explanation
BACKGROUND: Ordinance 0926-2005 authorized the acceptance of a grant under the Hazard Mitigation Grant Program, State of Ohio, Department of Public Safety, Ohio Emergency Management Agency. Three homes in northeast Columbus were built over an ancient bog and lakebed. The subsurface was unable to support these homes resulting in significant foundation and above-foundation structural damage. Consequently, the homes were sinking in the ground and causing ongoing damage, including, but not limited to, basement floors visibly sagging (5-inches or more in some areas) and voids existing beneath the floors.
The Hazardous Mitigation Grant Program funds allowed the Department of Development to eliminate the risk of future damage, hardship, loss and suffering resulting from this subsidence below the homes. The City acquired the impacted properties, demolished the existing structures and back-filled the respective structures. In addition, green space was created on the permanently vacated lots.
This ordinance authorizes the City of Columbus to return unspent grant funds to the State of Ohio, Department of Public Safety, Ohio Emergency Management Agency. The City of Columbus was to match the State of Ohio grant at 25% of the total project cost and because project costs were under what was originally estimated, grant funds will need to be returned.
This legislation is submitted as an emergency in order to close of the grant by the closeout date.
FISCAL IMPACT: This legislation requests the appropriation and expenditure authorization of $31,918.00 in order to close out the Balsamridge Project grant.

To authorize the appropriation and expenditure of $2,356.36 from the General Government Grant Fund for the reimbursement of unspent grant funds to the State of Ohio; to authorize the appropriation and expenditure of $29,561.64 from the Urban Development Action Grant - Capitol South Fund for the reimbursement of unspent grant funds to the State of Ohio; and to declare an emergency ($31,918.00)

WHEREAS, the Department of Development entered into an agreement with State of Ohio, Department of Public Safety, Ohio Emergency Management Agency, by which Ohio Emergency Management Agency provided funding to eliminate the risk of future damage, hardship, loss and suffering resulting from this subsidence below the homes through the City's acquisition of the impacted properties, the demolition of the existing structures, back-fill of the respective structures, and the creation of green space on the permanently vacated lots; and
WHEREAS, total project costs were less than what was budgeted; and
WHEREAS, it is necessary to authorize the appropriation and expenditure to return grant funds to the state agency for the aforementioned activities in the amount of $31,918.00; and
WHEREAS, an emergency exists in the usual daily operation of the City of Columbus in that it is immediately necessary to appropriate and expend said funds, all for the immediate preservation of the public health, property, safety and welfare; NOW, THEREFORE,
BE IT ORDAINED BY THE COUNCIL OF THE CITY OF COLUMBUS:
Section 1. That from the unappropriated monies in the fund known as the General Government Grant Fund, Fund No.220, Grant Number 445017 and from all monies estimated to come into said fund from any and all sources during the 12 months ending December 31, 2007, $2,356.36 is appropriated as follows:

Section 2. That from the unappropriated monies in the fund known as the Urban Development Action Grant Fund - Capitol South, Fund No. 243, Subfund No. 016, and from all monies estimated to come into said fund from any and all sources during the 12 months ending December 31, 2007, $29,561.64.00 is appropriated as follows:

Section 3. That the Development Director is hereby authorized to make payment in the amount of $31,918.00 to the State of Ohio for the reimbursement of unspent grant funds.
Section 4. That the expenditure of $2,356.36 or so much thereof as may be necessary, be and is hereby authorized to be expended from the General Government Grant Fund, Department of Development, Department No, 44-01 as follows:

Section 6. That for the reasons stated in the preamble hereto, which is hereby made a part hereof, this ordinance is hereby declared to be an emergency measure and shall take effect and be in force from and after passage and approval by the Mayor, or ten days after passage if the Mayor neither approves nor vetoes the same.
