Title: To authorize the Director of the Department of Public Utilities to execute those documents necessary to release a certain sewer easement, located along Cardinal Park Drive, at the request Village Communities, the developer, in exchange for a replacement easement previously granted to the City of Columbus, Ohio.
Explanation
 
Background:    The City of Columbus, Ohio is the holder of certain sanitary sewer easement, located along Cardinal Park Drive, by virtue of a recorded deed of easement.  Village Communities, the developer, has requested the City release a portion of its easement in exchange for a previously granted replacement easement.  After investigation, the Department of Public Utilities has been determined that the subject release of easement will not adversely affect the City and therefore should be granted.  The following legislation authorizes the Director of the Department of Public Utilities to execute those instruments necessary to release the subject sewer easement.

Title
 
To authorize the Director of the Department of Public Utilities to execute those documents necessary to release a certain sewer easement, located along Cardinal Park Drive, at the request Village Communities, the developer, in exchange for a replacement easement previously granted to the City of Columbus, Ohio.
 
 
Body
 
WHEREAS,      the City of Columbus, Department of Public Utilities, is the owner of a certain sanitary sewer easement by virtue of a recorded deed of easement in the Franklin County Recorders Office; and
 
WHEREAS,      Village Communities, the developer, has requested that a portion of the sewer easement, fully described in the body of this legislation, be released in exchange for a replacement easement previously granted to the City of Columbus; and
 
WHEREAS,      after investigation, The Department of Public Utilities, Division of Sewerage & Drainage, has determined that the release of the subject easement will not adversely affect the operations of the City of Columbus; now, therefore
 
 
BE IT ORDAINED BY THE COUNCIL OF THE CITY OF COLUMBUS:
 
 
      Section 1.      That the Director of the Department of Public Utilities be, and hereby is authorized to execute those documents, approved by the Department of Law, Real Estate Division, necessary to release the following described real property:
 
RELEASE OF EASEMENT
0.297 ACRE
 
Situated in the State of Ohio, County of Franklin, City of Columbus, located in Quarter Township 3, Township 1, Range 16, United States Military Lands, being on, over, and across that original 19.407 acre tract as conveyed to Traditions At Creekview, LLC by deed of record in Instrument Number 200507130137845 (all references refer to the records of the Recorder's Office, Franklin County, Ohio), and being described as follows:
Beginning, for reference, at the northeasterly corner of Grantor's tract, at the northwesterly terminus of Cardinal Park Drive, being on the southerly line of "Wellington Woods" of record in Condominium Plat Book 78, Page 74;
thence South 01° 58' 04" West, with the westerly right-of-way line of Cardinal Park Drive, a distance of 206.96 feet to a point;
thence North 88° 01' 56" West, across Grantor's tract, a distance of 171.43 feet to the TRUE POINT OF BEGINNING;
thence continuing across Grantor's tract, the following courses and distances:
South 03° 56' 46" West, a distance of 20.00 feet to a point;
North 86° 03' 14" West, a distance of 231.03 feet to a point;
South 04° 06' 06" West, a distance of 121.75 feet to a point;
South 04° 01' 38" West, a distance of 269.02 feet to a point on the northerly line of that existing sanitary sewer easement of record in Instrument Number 200507190142590;
South 62° 25' 27" West, with said northerly existing sanitary sewer easement, a distance of 23.48 feet to a point;
North 04° 01' 38" East, a distance of 281.34 feet to a point;
North 04° 06' 06" East, a distance of 141.71 feet to a point; and
South 86° 03' 14" East, a distance of 250.97 feet to the TRUE POINT OF BEGINNING and containing 0.297 acre of land, more or less.
