BACKGROUND:  This Ordinance authorizes the Director of Public Utilities to modify and increase the professional engineering services contract with MS Consultants, Inc. for the Parsons Avenue Water Plant (PAWP) Sludge Disposal Project, Division of Power and Water Contract No. 1118.
 
MS Consultants, Inc. was contracted by the City to provide site assessments of three existing sludge lagoons at the Parsons Avenue Water Plant (PAWP), prepare a written technical design report summarizing the findings and proposed solutions, and provide bid drawings and specifications for the removal and disposal of the lime softening sludge from the lagoons.  It was the City's intent to have MS Consultants, Inc. perform construction administration/inspection services and post construction site reconnaissance of interior piping and lagoon embankments through contract modifications.  
 
Part 1 construction contract was awarded for sludge removal from lagoon 2.  MS Consultants, Inc. performed construction inspection/administration services for Part 1 construction under approved Contract Modification 1.
 
A construction contract has been awarded for Part 2 of this project and  Modification No. 2 is now required to authorize MS Consultants, Inc. to continue construction inspection/administration services for Part 2 construction.  Also included in the scope of service for contract modification no. 2 are professional services for preparation of an Emergency Action Plan (EAP) and an Operation, Maintenance, and Inspection Manual (OM&I) for the Class II Parsons Avenue Water Plant dam structures.

2.      Reasons additional goods/services could not be foreseen:   
This modification was indicated in the original authorizing legislation Ordinance No. 1136-2008 and also indicated in the authorizing legislation for Modification #1, Ord. No. 1688-2009.
 
3.      Reason other procurement processes are not used:  
As indicated in the original contract legislation and the contract modification #1 legislation, this modification was always planned.  During the preparation of the original engineering scope development it was decided that it was not possible to accurately project anticipated costs for construction administration and construction inspection until the design work had been substantially completed.  Costs associated with this contract modification were more accurately determined as the design work progressed and a construction contract was awarded.    
 
4.      How cost of modification was determined:
MS Consultants, Inc. prepared and submitted a detailed estimate of cost to complete services outlined in Schedule 1, scope of services, of contract modification no. 2.  City project management staff reviewed and approved these cost summaries.

Searches in the Excluded Party List System (Federal) and the Findings for Recovery list (State) produced no findings against MS Consultants, Inc.
 
 
FISCAL IMPACT:  This legislation includes a transfer of funds within the Water Build America Bonds Fund and an amendment to the 2011 Capital Improvements Budget.

WHEREAS, Contract No. EL008712 was authorized by Ordinance No. 1136-2008, passed July 21, 2008, was executed on September 29,  2008, and was approved by the City Attorney on October 2, 2008; and
 
WHEREAS, Modification No. 1 EL010091 was authorized by Ordinance No. 1688-2009, passed January 25, 2010 was executed on February 26, 2010, and was approved by the City Attorney on March 10, 2010; and
 
WHEREAS, Modification No. 2 is needed for construction inspection/administration services for Part 2 construction.  Also included in the scope of service for contract modification no. 2 are professional services for preparation of an Emergency Action Plan (EAP) and an Operation, Maintenance, and Inspection Manual (OM&I) for the Class II Parsons Avenue Water Plant dam structures; and
 
WHEREAS, it is necessary for this Council to authorize the City Auditor to transfer and expend funds within the Water Build America Bonds Fund; and
 
WHEREAS, it is necessary to authorize an amendment to the 2011 Capital Improvements Budget for purposes of providing sufficient funding and expenditure authority for the aforementioned project expenditure; and
 
WHEREAS, it has become necessary in the usual daily operation of the Department of Public Utilities, Division of Power and Water, to authorize the Director of Public Utilities to modify and increase the professional engineering services contract with MS Consultants, Inc. for the Parsons Avenue Water Plant (PAWP) Sludge Disposal Project, for the preservation of the public health, peace, property, safety and welfare; now, therefore,
 
BE IT ORDAINED BY THE COUNCIL OF THE CITY OF COLUMBUS:
 
SECTION 1.  That the Director of Public Utilities is hereby authorized and directed to modify and increase the professional engineering services contract with MS Consultants, Inc. for the Parsons Avenue Water Plant (PAWP) Sludge Disposal Project, for the Division of Power and Water, in the amount of $1,080,242.00.
SECTION 2.  That this contract modification is in compliance with Section 329.16 of Columbus City Codes, 1959.
 
SECTION 3.  That the City Auditor is hereby authorized to transfer $1,080,242.00 within the Department of Public Utilities, Division of Power and Water, Water Build America Bonds Fund, Fund No. 609, Dept./Div. No. 60-09, Object Level Three 6686, as follows:

SECTION 5.  That the expenditure of $1,080,242.00 is hereby authorized for the Parsons Avenue Water Plant (PAWP) Sludge Disposal Project within the Water Build America Bonds Fund, Fund No. 609, Division 60-09, Project No. 690414-100000 (carryover), Object Level Three 6686, OCA Code  609414.
 
SECTION 6.  That the City Auditor is hereby authorized and directed to transfer any unencumbered balance in the project account to the unallocated balance within the same fund upon receipt of certification by the Director of the Department administering said project that the project has been completed and the monies no longer required for said project; except that no transfer shall be made from a project account by monies from more than one source.
 
SECTION 7.  That the City Auditor is authorized to establish proper project accounting numbers as appropriate.
 
SECTION 8.  That the City Auditor is authorized to make any accounting changes to revise the funding source for all contracts or contract modifications associated with this Ordinance.
 
SECTION 9.  That this Ordinance shall take effect and be in force from and after the earliest period allowed by law.
