Title: To authorize the City Attorney to execute a property damage release and accept a payment of $69,155.00 on behalf of the Department of Public Utilities to settle a property damage claim; to authorize the City Auditor to deposit the funds into the Land Stewardship Fund
Explanation

This Ordinance is submitted to authorize the acceptance of a payment and execution of a liability release to resolve a property damage claim for damage to property adjacent to 9063 Oakwood Point. The damaged property is owned by the city and managed by the Department of Public Utilities (“DPU”). DPU assessed damage due to tree removal and trimming in an amount of $69,155.00. The adjacent property owner, Margina Romine's insurance company, Liberty Mutual Insurance, has agreed to pay this amount to resolve the claim. This legislation authorizes the City Attorney to execute a property damage release and accept payment of $69,155.00 on behalf of DPU. This legislation further authorizes the City Auditor to deposit the funds into the Land Stewardship Fund in accordance with Section 1117.06 of the Columbus City Codes.

Body

WHEREAS, the Department of Public Utilities assessed damage to city-owned property adjacent to 9063 Oakwood Point in an amount of $69,155.00; and
WHEREAS, the adjacent property owner’s insurance company, Liberty Mutual Insurance has agreed to pay this amount to resolve the claim; and
WHEREAS, it is necessary to authorize the City Attorney to execute a property damage release and accept payment of $69,155.00 on behalf of the Department of Public Utilities to resolve this claim; and
WHEREAS, it is necessary to authorize the City Auditor to deposit the funds into the Land Stewardship Fund in accordance with Section 1117.06 of the Columbus City Codes; and NOW, THEREFORE
BE IT ORDAINED BY THE COUNCIL OF THE CITY OF COLUMBUS:
