Explanation

Background: Ordinance No. 0361-2009, Passed April 4, 2009, authorized the City Attorney to acquire certain property rights, and to expend certain monies in connection with the OSIS Augmentation and Relief Sewer (OARS) Project. The funding made available for this project by 0361-2009 was done so with the understanding that additional monies may be needed at a later date. It is now necessary to authorize the City Attorney to acquire additional fee simple title and lesser interests, contract for any additional necessary professional services, and to expend additional money for payment of acquisition costs in connection with the OSIS Augmentation and Relief Sewer (OARS) Project.

Fiscal Impact: This ordinance authorizes the Department of Public Utilities, Division of Sewerage and Drainage, to transfer within and expend $5,190.00 from the Sanitary Build America (B.A.B.s) Fund, Fund 668 and to amend the 2010 Capital Improvements Budget to establish sufficient budget authority.

Emergency Justification: Emergency action is requested to allow the acquisition of real property necessary to the completion of this project to proceed without delay.
