Explanation
This ordinance is submitted to settle the claim of Sarah Kroger against the City of Columbus in the amount of Sixty-five Thousand Dollars ($65,000.00).
Title
To authorize and direct the City Attorney to settle the claim of Sarah Kroger and authorize the expenditure of the sum of Sixty-five Thousand Dollars ($65,000.00) in settlement of this claim and to declare an emergency.
Body
WHEREAS, on January 22, 2006, Sarah Kroger was arrested by Columbus Police Officers Bridget Kimbrough and Raymond Miller on suspicion of operating a motor vehicle while intoxicated; and,
WHEREAS, Miss Kroger was taken into police custody and taken to the ID waiting room of the Columbus Police Division; and,
WHEREAS, during the processing of Miss Kroger, unnecessary force was used against Miss Kroger by Officer Kimbrough; and,
WHEREAS, unnecessary force was used against Miss Kroger while she was on an elevator at the Columbus Police Headquarters; and,
WHEREAS, Miss Kroger received injuries and damages as a result of said unnecessary force; and,
WHEREAS, it is in the best interests of the City of Columbus to settle this case in the total amount of Sixty-five Thousand Dollars ($65,000.00); and,
WHEREAS, by reason of the foregoing an emergency exists in the usual operations of the City and it would be in the City's best interests to compromise and settle this matter and for further preservation of the public health, peace, property, safety and welfare, now, therefore:
BE IT ORDAINED BY THE COUNCIL OF THE CITY OF COLUMBUS
SECTION 1. The City Attorney be and hereby is authorized and directed to settle the claim of Sarah Kroger by the payment of Sixty-five Thousand Dollars ($65,000.00).
SECTION 2. That for the purposes of paying this settlement, there be and hereby is authorized to be expended by the City of Columbus, Department of Public Safety, Division of Police, General Fund 010, Division Number 30-03, OCA Code 301382, Obj...
