Title: To authorize the Director of the Department of Development, or an authorized signatory, to execute documents approved by the Columbus City Attorney, Real Estate Division, to grant perpetual Highway Easements to the State of Ohio, Department of Transportation on a portion of the City owned property; and to declare an emergency. Explanation

BACKGROUND: The City desires to grant to the State of Ohio, Department of Transportation (“ODOT”),
a perpetual easement for highway purposes on a portion of City-owned real property located along the western side of Riverside Drive, north of the terminus of River Park Drive on Griggs Reservoir and Park [Franklin County Tax Parcel 580-198700] (“Easement”). ODOT will use the Easement, which is more fully described within the attachment to this legislation, for the reconstruction of a bridge with ODOT’s [FRA-33-8.78] project (“Project”). The Division of Real Estate and Land Redevelopment reviewed the easement request and determined that the request should be granted and charge Twenty-Seven Thousand and 00/100 U.S. Dollars ($27,000.00) for the easement. Therefore, the following legislation authorizes the City’s Director of the Department of Development, with approval from the Directors of the Recreation and Parks Department and the Department of Power and Water, to execute those documents as approved by the Columbus City Attorney, Real Estate Division, to grant the easements to ODOT to complete the Project.

FISCAL IMPACT: No funds are required. The City’s receipt of Twenty-Seven Thousand and 00/100 U.S. Dollars ($27,000.00) will be deposited within three separate funds, including the Water Operating Fund, Recreation and Parks Permanent Improvement Fund, and the Real Estate Management Fund.

Emergency Justification: Emergency action is requested by ODOT to facilitate their construction timelines and to not delay the benefit to the City resulting from the project, which will preserve the public peace, health, property, safety, and welfare.
