Title: To authorize the Director of Public Utilities to execute a construction contract with the Kokosing Construction Company, in connection with four sanitary sewer relief projects and one roadway improvement project located within the North Linden community; to authorize the appropriation and the expenditure of $2,547,963.02 from the Ohio Water Pollution Control Loan Fund; the transfer and expenditure of $217,381.98 from within the Voted Sanitary Bond Fund; and the expenditure of $1,484,381.25 from the Voted Streets and Highway Fund; to amend the 2005 Capital Improvements Budget, for the Division of Sewerage and Drainage; and to declare an emergency. Explanation
1. BACKGROUND: This legislation authorizes the Director of Public Utilities to execute a contract with the Kokosing Construction Company in the amount of $4,249,726.25 for the construction of four sanitary sewer improvement projects and one roadway improvement project:

a. Atwood Terrace/Lenore Avenue Relief Sewer - $565,639.80
b. Atwood Terrace/Northridge Rd. Relief Sewer - $715,989.45
c. Weldon Ave. Sanitary Relief Sewer - $503,147.15
d. Lenore Ave./Huy Rd. Sanitary Relief Sewer - $980,568.60
e. Atwood Terrace Roadway Improvements, Piedmont to Norris - $1,484,381.25

The Director of Public Utilities publicly opened four competititve bid proposals on January 11, 2006. The results of these bids were the Kokosing Construction Company submitted a bid of $4,249,726.25; Nicholas M. Savko & Sons submitted a bid of $4,334,889.90; Complete General Construction Company submitted a bid of $4,421,920.25 and the George J. Igel Company submitted a bid of $4,559,269.22.

2. FISCAL IMPACT: The Ohio Water Development Authority approved a loan to the City for these projects during its March 30, 2006 Board Meeting. The loan proceeds being appropriated herein include the cost of construction services. The Division of Sewerage and Drainage is required to fund pavement and curb pay items that the Ohio EPA deemed ineligible for funding under the Ohio Water Pollution Control Loan Fund program. This legislation also requests authority for the Director of Public Utilities to incorporate the construction of a roadway improvement project into said sewer contract; and to utilize Department of Public Service funds to pay for the roadway portion. The Department is requesting an amendment to the 2005 Capital Improvements Budget to accomodate this expenditure.
