Title: To authorize and direct the Finance Director to modify by extending a contract for the option to purchase 300 Gallon Refuse Containers with Rotonics Manufacturing, Inc., and to declare an emergency.
Explanation

BACKGROUND: To modify a contract for the option to purchase 300 Gallon Refuse Containers for the Department of Public Service Refuse Collection Division, the largest user. The term of the proposed option contract modification will be one year, through February 19, 2006.

To establish the original contracts, the Purchasing Office advertised and solicited competitive bids in accordance with Section 329.06 (Solicitation No.SA000078). Thirty-seven (MAJ:35) (M1A:2) were bids solicited; one (MAJ:1) bid was received. The Purchasing Office recommended the contract be awarded to Rotonics Manufacturing Inc., contract compliance number 36-2467474, as the lowest, responsive, responsible and best bidder and a contract was established in accordance with the passage of Ordinance 0197-2002:

1. Amount of additional funds: The estimated annual expenditure for the contracts is $1,211,250.00. The Department of Public Service Refuse Collection Division must obtain approval to expend from their own budgeted funds for their estimated expenditures.
2. Reason additional needs were not foreseen: The need was foreseen. An extension is provided for in the original contract.
3. Reason other procurement processes not used: No lower pricing or better terms are anticipated by rebidding.
4. How cost was determined: The cost, terms and conditions are in accordance with the original contracts

The company is still not listed on the State of Ohio Unresolved Findings for Recovery Database, and they are not debarred according to the Federal Excluded Parties Listing.

This ordinance is being submitted as an emergency because, without emergency action, no less than thirty-seven days will be added to this procurement cycle and the efficient delivery of valuable public services will be slowed.
