Explanation

BACKGROUND: The case of Kanode v. City of Columbus, et al, 23-cv-004880, pending in the Franklin County Court of Common Pleas, was filed on July 11, 2023 naming the City of Columbus as well as former Department of Public Safety employee Richard Wozniak as defendants. In accordance with the Ohio Rules of Professional Conduct, outside counsel was retained to represent the City in this matter. Contract PO396484 was executed with Isaac Wiles Burkholder & Teetor LLC for outside legal counsel services on July 25, 2023. Additional funds are now needed to allow for continued representation.

The company is not debarred according to the Excluded Party Listing System of the Federal Government or prohibited from being awarded a contract according to the Auditor of State Unresolved Findings for Recovery Certified Search.

1. Amount of additional funds: Total amount of additional funds needed for this contract modification is $73,500.00. Total contract amount including this modification is $123,500.00.

2. Reason additional funds were not foreseen: The potential need for additional funds was known and provided for at the time of the initial contract.

3. Reason other procurement processes were not used: Work under this modification is a continuation of services included in the scope of the original contract. No lower pricing/more attractive terms and conditions are anticipated at this time.

4. How was cost determined: The City and contractor agreed upon a blended rate of $250.00 per hour for services which will be paid after the submittal of a detailed monthly invoice documenting the work performed in completion of the scope of services.
