Title: To authorize and direct the Finance Director to enter into a Memorandum of Understanding with The Ohio State University Hospitals to participate in contracts available through Novation and to assign any and all patronage refunds that it may now or hereafter be entitled to receive to The Ohio State University Hospitals, to waive the provisions of Columbus City Cods Sections 329.05, 329.06 and 329.14 (a)-(e) inclusive, and to declare an emergency.

Explanation

The purpose of this legislation is to establish the authority for the City of Columbus to purchase through the Novation Company where it is considered prudent by the Finance Director. This authority would be in effect for three (3) years. At present, substantial savings opportunities have been discovered if the City obtains its pharmaceuticals via the Novation Company. Other opportunities are being reviewed.

In order to purchase through Novation, the City needs to execute a Memorandum of Understanding with The Ohio State University Hospitals wherein The Ohio State University Hospitals does sponsor the City of Columbus as an Alternate Purchasing Location and in turn, the City of Columbus assigns any due "patronage refunds" to the Ohio State University.

In accordance with Section 329.27 of the Columbus City Code, it is in the best interest of the City to waive the requirements of Sections 329.06 (Formal Competitive Bidding) of the Columbus City Code to establish our authority to enter into the Memorandum of Understanding and establish access to contracts competitively bid by Novation. City agencies that need to buy via a contract with a Novation vendor, where the expenditure will be more than $20,000, will still be required to seek City Council and Mayor approval before the contract can be established. In addition, they will be required to seek legislation in accordance with Section 329.27 of the Columbus City Code until such time as the City Code is updated to enable cooperative purchasing.
