Title: To authorize the Director of the Department of Development to modify a professional services contract with MKSK Inc. to extend the contract for one additional year to continue a strategic update to the Big Darby Accord Watershed Master Plan; to authorize the expenditure of up to$75,000.00 from the Columbus Water & Power, Sewer Operating Sanitary fund ,contingent on the passing of Ord. 2939-2025; to authorize the appropriation and expenditure of up to $25,000.00 from the Neighborhood Economic Development (NED) fund; and to declare an emergency. ($100,000.00)

Explanation

BACKGROUND: This legislation authorizes the Director of Development to modify a professional services contract with MKSK Inc., in an amount up to $100,000.00, to continue updating the Big Darby Accord Watershed Master Plan, with an extended timeline for completion thru February 28th, 2027.

Total contract amount $ 350,000.00

In accordance with C.C. 329.09(a):
1. The amount of additional funds being requested under this modification is $100,000.00.
2. The need for additional services was unforeseen at the time the initial contract was awarded, but a legislative modification is required by operation of C.C. 329.09(b).
3. It is in the City’s best interest to continue with MKSK Inc.’s current contract as they were part of the consultant team that developed the current Accord document and is well positioned to undertake this task and to maintain the planning timeline. A waiver of the competitive procurement was requested as part of ORD 3230-2024, as MKSK Inc. was part of the consultant team that developed the current Accord document.
4. The price for the additional services in this modification was determined by discussions between the Project Manager and Contractor regarding services necessary to complete the scope, with guidance from the Division of Planning staff.

The Big Darby Accord Watershed Master Plan was adopted by the City of Columbus and partner jurisdictions in 2006. The central objective of the Plan is protecting the Big Darby Creek by balancing conservation and development in a manner that allows for responsible growth and long-term sustainability of the watershed.
