Explanation
Background: Ordinance No. 0706-2006 passed April 24, 2006 authorizing the City Attorney to acquire certain property rights, and to expend certain monies in connection with the Charleston Avenue Stormwater System Improvements Project. The original amount of funding made available for this project was done so with the understanding that additional monies may be needed at a later date. It is now therefore necessary to establish a separated Auditor's Certificate to expend monies for payment of additional acquisition costs in connection with the Charleston Avenue Stormwater System Improvements Project.
Fiscal Impact: The Department of Public Utilities, Division of Sewerage and Drainage has determined funding for this project will be from the Storm Sewer Bond Fund. The legislation includes a transfer of funds within the Storm Sewer Bond Fund and an amendment to the 2007 Capital Improvements Budget to allow sufficient cash and authority in the proper account for this project.
Emergency Justification: Emergency action is requested to allow the acquisition of the parcels necessary for this project to proceed without delay.

To authorize the City Attorney to acquire fee simple title and lesser interests, and to contract for professional services; to authorize the transfer of $30,500.00 within the Storm Sewer Bond Fund; to authorize the amendment of the 2007 Capital Improvements budget; and to authorize the expenditure of $30,500.00 from the Storm Sewer Bond Fund; for costs in connection with the Charleston Avenue Stormwater System Improvements Project, and to declare an emergency. ($30,500.00).
