Explanation

BACKGROUND: To modify and extend the existing city-wide contracts for the option to purchase Flygt Pump & Mixer Parts and Service for the Sewerage & Drainage Division to and including August 31, 2005.

The Purchasing Office advertised and solicited competitive bids in accordance with Section 329.06. Formal bids were opened April 4, 2002 (SA000226: 2 bids received: MAJ 2; 78 bids solicited: MAJ 77, FBE 1; Contract FL001346 with Mid Ohio Electric Company (contract compliance #31-4416140) and FL001347 with The Henry P. Thompson (contract compliance #31-0515994) were approved per Ordinance #1638-02, passed November 4, 2002. Neither of these companies is debarred according to the Excluded Party Listing System of the Federal Government and neither is listed in the Auditor of State's database for Unresolved Findings for Recovery.

1. Amount of additional funds: No funding is required to extend these option contracts. Sewerage and Drainage must obtain approval to expend from their own budgeted fund for their estimated annual expenditure of $115,000.00.
2. Reason additional needs were not foreseen: Not applicable. The original contracts were established with the option to renew if all parties agree.
3. Reason other procurement processes not used: It is in the best interest of the City to continue to utilize the terms, conditions and pricing in the existing contracts.
4. How cost was determined: Pricing is in accordance with SA000226.

FISCAL IMPACT: No funding is required to extend the option contracts.

This ordinance is being submitted as an emergency because without emergency action, no less then thirty-seven days will be added to the procurement cycle and the efficient delivery of valuable public services will be slowed.
