Explanation

BACKGROUND: To authorize and direct the Director of Public Safety to modify and extend the contract with LexisNexis Risk & Information Analysis, for the purpose of providing continued computer investigative database access for background searches. The Real Time Phones upgrade to the current Phones Plus feature was added to the existing flat rate plan for 130 users in 2010. The original contract, EL008134, took effect March 1, 2008, and includes the option to renew for three additional, one-year terms. This renewal will be the fourth year (of four) including the upgraded feature. There is also a need to appropriate $74,244.00 in the Division's Law Enforcement Seizure Funds for the purchase of these services.

This company is not debarred according to the Federal excluded parties listing or prohibited from being awarded a contract according to the Auditor of State unresolved findings for recovery certified search.

Emergency Designation: Emergency legislation is requested so that the contract can be immediately modified and extended for the fourth and final year of services allowed under renewal terms of the original contract. The current contract expired on February 28, 2011.

FISCAL IMPACT: This ordinance authorizes an appropriation and expenditure of $74,244.00 from the Law Enforcement Contraband Seizure Fund with LexisNexis Risk & Information Analysis for the Division of Police. Since this purchase will be made with Law Enforcement Contraband Seizure Funds, there will be no impact to the financial status of the General Fund. The Division of Police encumbered or spent 67,620.00 in 2010, $50,844.00 in 2009 and $44,500.00 in 2008 for these services.
