Explanation
BACKGROUND: This legislation authorizes the Finance and Management Director to establish a Universal Term Contract (UTC) for the option to purchase Envirex Parts with Evoqua Water Technologies, LLC. The Department of Public Utilities is the primary user for these items. Evoqua is the proprietary manufacturer of various clarifiers, skimming concentrators and basin collectors that are used at the City’s water and wastewater plants. Evoqua Water Technologies, LLC. is the sole source for these parts as they are the only distributor for their own products. The term of the proposed option contract would be approximately two (2) years, expiring July 31, 2026 with the option to renew for one (1) additional one (1) year term. In addition, the expenditure of $1.00 is hereby authorized from General Budget Reservation BRPO003196.

Emergency Designation: The Finance and Management Department respectfully requests this legislation to be considered an emergency ordinance because the current contract expired 3/31/2024; and these parts need to be readily available to ensure that water treatment equipment is functioning properly.
The company is not debarred according to the Excluded Party Listing System of the Federal Government or prohibited from being awarded a contract according to the Auditor of State Unresolved Findings for Recovery Certified Search.
FISCAL IMPACT: The expenditure of $1.00 is hereby authorized from General Budget Reservation BRPO003196.
