BACKGROUND: This contract provides for Water Line Rehabilitation - Hamilton/Broad Street Water Line Improvements. Competitive bids were received and opened for this project at the office of the Director of Public Utilities on October 12, 2005. Three (3) bids were received on this project. The most responsive and responsible bid was submitted by Darby Creek Excavating, Inc., 6790 Brooks Miller Road, Circleville , Ohio 43113. Contract to be awarded to same.

FISCAL IMPACT: Funds are being transferred to provide the funding for this project.

WHEREAS, the Director of Public Utilities did receive and open bids on October 12, 2005 for Water Line Rehabilitation - Hamilton/Broad Street Water Line Improvements, and

WHEREAS, a responsive and responsible bid has been received, and

WHEREAS, in the usual daily operations of the Division of Water, Department of Public Utilities it is necessary to authorize the Director of Public Utilities to enter into a contract for Water Line Rehabilitation - Hamilton/Broad Street Water Line Improvements for the Division of Water for the preservation of public health, peace, property, safety and welfare; Now, Therefore,
