Explanation
1. Background
The Homewood Corporation, by Barry Holmes, President, owner of the platted land, has submitted the plat titled “Orchard Lakes Section 2” to the City Engineer’s Office for review and approval. This plat has been reviewed and approved by the City Engineer. The following ordinance allows the City to accept said plat for property located for a subdivision of lots numbered 64 through 100 inclusive.

2. Fiscal Impact
There is no fiscal impact to the City to accept the plat.

3. Emergency Justification
Emergency action is requested, to allow new development in the area of Orchard Lakes Section 2 due to the short construction season in Ohio. This will allow the plat to be recorded as soon as possible, so the County can issue parcel numbers, allowing the development to proceed, certified addresses to be issued, construction of proposed roads, and homes/buildings to be built. Additionally, it will allow the inspection and Construction Agreement to be finalized with the City.

WHEREAS, the plat titled “Orchard Lakes Section 2” (hereinafter “plat”) has been submitted to the City Engineer’s Office for approval and acceptance; and

WHEREAS, Homewood Corporation, by Barry Holmes, President, owner of the platted land, desires to dedicate to the public use all or such parts of the avenues and easements shown on said plat and not heretofore so dedicated; and

WHEREAS, after examination, it has been found to be in the best interest of the City to accept said plat; and

WHEREAS, an emergency exists in the usual daily operation of the Department of Public Service in that said plat should be accepted immediately to allow new development in the area of Orchard Lakes Section 2 to proceed as quickly as possible due to the short construction season in Ohio.
