Explanation

Background: This legislation authorizes a modification to the design contract with Woolpert, Inc. for the Karl Road Improvement project. It is estimated that construction will begin in the spring of 2009 and end in the fall of 2009. The project is located on Karl Road between State Route 161 to the south and Schrock Road to the north. The purpose of the project is to provide new roadway surfacing, new curbs, sidewalks, street lighting and storm drainage. As the project commenced it was determined that left turn lanes at Alpine Drive should be added, which required additional design of the roadway and the right-of-way. This modification is necessary to compensate the vendor for additional design work and to assure timely completion of the design, as the Transportation Division does not maintain adequate staff or all of the various disciplines necessary to complete such design in house.

This modification is an addition to the original scope of services but is a continuation of the existing work being performed and it would not be practical to contract with a different consultant.

Current hourly rate, the overhead rate and percentage of profit that were negotiated at the beginning of this project were used to determine the amount of this modification. Woolpert, Inc., CC # 201391406, Expires 1/31/08, was selected in 2005 in accordance with Chapter 329 for professional service contracts.

The original contract amount was $475,085.00. The amount of this modification is $24,905.00. The total of all modifications is $24,905.00. The contract amount, including all modifications is $499,990.00. AC025184 has $12,965.00 remaining from ordinance 1647-2005 legislated for this design contract which will be used along with the $11,940.00 this ordinance authorizes for expenditure.

Emergency action is requested for immediate modification of the design contract for the earliest possible completion of the design to stay on schedule for construct...
