APPLICANT: Rare Hospitality, Inc.; c/o Brian Lorenz; 1201 Dublin Road; Columbus, Ohio 43215.

PROPOSED USE: Restaurant development.

DEVELOPMENT COMMISSION RECOMMENDATION: Approval (5-0) on June 10, 2004.

CITY DEPARTMENTS' RECOMMENDATION: Approval. The requested CPD, Commercial Planned Development District will allow a restaurant development. The proposed CPD plan and text provide use restrictions and development standards that are consistent with the Northland Development Standards and surrounding zoning districts, and is consistent with the zoning and development patterns of the area.

WHEREAS, application #Z04-038 is on file with the Building Services Division of the Department of Development requesting rezoning of 1.69± acres from L-C-4, Commercial Development District to CPD, Commercial Planned Development District; and

WHEREAS, the Development Commission recommends approval of said zoning change; and

WHEREAS, an emergency exists in the usual daily operation in the City of Columbus in that it is immediately necessary to amend this legislation to emergency due to the applicant's contractual deadlines with the landlord and the desire to start construction prior to winter build conditions for the immediate preservation of the public peace, property, health and safety; and

WHEREAS, the City Departments recommend approval of said zoning change because the requested CPD, Commercial Planned Development District will allow a restaurant development with use restrictions and development standards that are consistent with the Northland Development Standards and the zonin...
