Title: To authorize the Director of Public Service to execute agreements with, and to accept contributions from, Flaherty & Collins Properties, the Daimler Group Inc., SP Office LLC, the River South Authority, the Scioto Peninsula New Community Authority, and any and all other entities as deemed necessary to support the construction of improvements as part of to the Roadway - Scioto Peninsula Roadway Improvements Phase 1 project; and to declare an emergency. Explanation
1. BACKGROUND
This ordinance authorizes the Director of Public Service to enter into agreements with and to accept contributions from Flaherty & Collins Properties, the Daimler Group Inc., SP Office LLC, the River South Authority, the Scioto Peninsula New Community Authority, and any and all other entities as deemed necessary relative to the Roadway - Scioto Peninsula Roadway Improvements Phase 1 project.
The aforementioned project encompasses the full depth reconstruction of Capital Street, Rush Alley, State Street, and Chapel Street from Starling Street to Belle Street and Starling Street and Belle Street from Broad Street to Town Street. As part of that effort, the City has agreed to construct, or to cause to be constructed, certain additional improvements benefiting private developments within the project limits. The construction of the additional improvements will be supported by monies contributed by those entities for that purpose.
2. FISCAL IMPACT
There will not be a cost to the City for the construction of the improvements benefiting the private developments. The contribution agreements allow the Department of Public Service to collect the funds for the improvements from the developers once bids have been received for the work. The work will not be performed if a developer changes their mind and decides not to contribute the funds to cover the cost of the construction.

3. EMERGENCY DESIGNATION
Emergency action is requested so as to allow for the execution of requisite agreements as soon as reasonably practicable so as to prevent unnecessary delays in the completion of the aforementioned project.
