Explanation

BACKGROUND: This resolution appoints a Board of Revision to hear objections that have been made to the Fourth and Elm Parking Facility Special Assessment.
The Charter of the City of Columbus provides City Council with the power by ordinance to provide for the construction, reconstruction, repair and maintenance by contract or directly by the employment of labor, of all local improvements, and to provide for the payment of any part of any such improvement by levying and collecting special assessments upon abutting, adjacent and contiguous or other specially benefited property. Should a property owner object to an assessment, Charter Section 172 calls for the appointment by City Council of a Board of Revision to hear such objections.

WHEREAS, on July 14, 2008, pursuant to Section 166 of the Columbus City Charter, Council passed Resolution No. 0132X-2008, declaring the necessity of acquiring, constructing, installing, equipping, or improving off-street parking facilities at the southeast corner of the intersection of Fourth and Elm Streets; and
WHEREAS, This legislation to establish a Board of Revision to hear objections to the Fourth and Elm Parking Facility is another in a series of ordinances subsequent to Resolution No. 0132X-2008 necessary to pay for public improvements such that action hereunder is deemed to be necessary pursuant to Section 55(b) of the Columbus City Charter, now, therefore
BE IT RESOLVED BY THE COUNCIL OF THE CITY OF COLUMBUS:
