Explanation
1. BACKGROUND:
A. Need. This legislation authorizes the Director of Public Utilities to modify the construction contract with Kokosing Construction Company, Inc. for the Southerly Wastewater Treatment Plant New Headworks Project. The modification amount requested under this ordinance is $1,092,642.00. The contract total including this modification is $45,947,099.00. The legislation will also authorize the City Auditor to transfer funds within the Sanitary Sewer Bond Fund and amend the 2007 Capital Improvements Budget, in connection with the Southerly Wastewater Treatment Plant New Headworks Project. These additional monies will fund known costs of needed additions to the contract work to provide the Schedule Recovery effort resulting from the January, 2005 project site flooding that would exceed the original contract contingency amount. The severity and impact of the wet weather events and site flooding experienced could not be foreseen, and it is not practical or feasible to undertake a new procurement to deliver these services.

D. Emergency Designation: The Division of Sewerage and Drainage hereby requests City Council to concur in the designation of this ordinance as an emergency measure, to assure that the construction contract work may continue uninterrupted, to avoid delays, to pay the contractor in a timely manner, and to enable the construction to continue to meet the schedule commitments set forth in the City's Consent Orders with the State of Ohio.
2. FISCAL IMPACT:
This legislation includes a transfer of cash between projects within the Sanitary Sewer Bond Fund and an amendment of the 2007 Capital Improvements Budget to establish sufficient funds and budget authority to cover the expenditure of $1,092,642.00 upon passage of this ordinance.
