Rezoning Application Z06-075

APPLICANT: Ohio Mulch; c/o Jeffrey L. Brown, Attorney; 37 West Broad Street, Suite 725; Columbus, OH 43215.

PROPOSED USE: Manufacturing uses and sales of landscape and garden materials and products.

DEVELOPMENT COMMISSION RECOMMENDATION: Approval (5-0) on December 14, 2006.

CITY DEPARTMENTS' RECOMMENDATION: Approval. The 3.07± acre site is undeveloped and zoned in the M-2, Manufacturing District. The M-2 district permits only a limited range of manufacturing uses. The applicant is requesting the L-M, Limited Manufacturing District, to permit the wholesale and retail sales of landscape and garden materials and products. The proposed use is consistent with the zoning and development in the area. The text provides appropriate use restrictions and development standards addressing lighting.

WHEREAS, application #Z06-075 is on file with the Building Services Division of the Department of Development requesting rezoning of 3.07± acres from the M-2, Manufacturing District to L-M, Limited Manufacturing District; and

WHEREAS, the Development Commission recommends approval of said zoning change; and

WHEREAS, an emergency exists in the usual daily operation in the City of Columbus in that it is immediately necessary to pass this ordinance to begin construction as soon as possible for the immediate preservation of the public peace, property, health and safety; and
