Explanation

BACKGROUND: This legislation authorizes the Director of Public Utilities to enter into two agreements with the Board of Commissioners of Franklin County, Ohio ("County"). The first agreement allows the County to provide water service to Mon-E-Bak Farms and Leonard Park. The second agreement transfers the County's water distribution assets in the Rickenbacker area to the City of Columbus. .


FISCAL IMPACT: There is no impact on the water and sewer service budget




Title

To authorize the Director of Public Utilities to enter into a contract with the Board of County Commissioners of Franklin County, Ohio ("County") to provide full water services for the Rickenbacker Service Area, Mon-E-Bak Farms and Leonard Park; and to declare an emergency.



Body

WHEREAS, in 2003, the City and the County entered into a master agreement for providing sewer service to a number of unincorporated areas in the County; and

WHERAS, in December 2010, pursuant to Ordinance 1824-2010, passed December 13, 2010, the City and County amended the 2003sewer agreement, and

WHEREAS, one of the terms of the December 2010 contract concerned entering into a contract authorizing water service to two subdivisions, known as Mon-E-Bak Farms and Leonard Park; and

WHERAS, the City and the County have agreed on the terms of the contract for water service to Mon-E-Bak Farms and Leonard Park; and

WHEREAS, another term in the December 2010 contract concerned entering into a full water service agreement between the parties for the Rickenbacker Area; and

WHERAS, the City and the County have determined that a transfer of the County water distribution assets in the Rickenbacker area would better meet the parties goals; and

WHEREAS, the City and the County have agreed on the terms of a contract for the Rickenbacker area, Now, Therefore
