Title: To authorize the Finance and Management Director to enter into a Universal Term Contract for the option to purchase Powdered Activated Carbon with Calgon Carbon Corporation; to authorize the expenditure of $1.00 from General Budget Reservation BRPO001107; and to declare an emergency. Explanation
BACKGROUND: This legislation authorizes the Finance and Management Director to establish a Universal Term Contract (UTC) for the option to purchase Powdered Activated Carbon with Calgon Carbon Corporation. The Division of Water is the sole user of Powdered Activated Carbon, used as a taste and odor control agent for potable water at two (2) Water Treatment Plants. The term of the proposed option contract would be approximately three (3) years, expiring March 31, 2023, with the option to renew for one (1) additional year. The Purchasing Office opened formal bids on January 9, 2020. In addition, the expenditure of $1.00 is hereby authorized from General Budget Reservation BRPO001107.

The Purchasing Office advertised and solicited competitive bids in accordance with the relevant provisions of Section 329 relating to competitive bidding (Request for Quotation No. RFQ014436). Samples are submitted by bidders to be tested and the resulting performance factors are then used to determine the most cost efficient product, as documented in the bid solicitation. Four (4) vendors submitted bids with one bidder offering two products while one bidder offered three products, for a total number of products being bid as seven (7).

The Purchasing Office is recommending award to the overall lowest, responsive, responsible and best bidder as follows:

Calgon Carbon Corporation, CC#001911 expires 1/9/22, All Items, $1.00
Total Estimated Annual Expenditure: $760,000, Division of Water, the sole user

Emergency Designation: The Finance and Management Department respectfully requests this legislation be considered an emergency measure as the current contract expires at the end of March 2020.

The company is not debarred according to the Excluded Party Listing System of the Federal Government or prohibited from being awarded a contract according to the Auditor of State Unresolved Findings for Recovery Certified Search.
