Explanation
1. BACKGROUND
This legislation authorizes the Director of Public Utilities to modify the contract with the Kokosing Construction Company, Inc., in connection with the Jackson Pike Wastewater Treatment Plant Sludge Holding System Improvement Projects. This legislation will additionally authorize the appropriation, transfer, and expenditure of funds from the Sewerage System Reserve Fund to the Ohio Water Pollution Control Loan Fund.

This contract provides for constructing Sludge Holding System Improvements at both the Jackson Pike Wastewater Treatment Plant and the Southerly Wastewater Treatment Plant. The contract includes construction of a building with sludge storage silos and truck loading bays at both plants, improvements to water systems piping and pumps, and replacement of a section of high voltage electrical service line.

This project work is being funded through the existing State of Ohio Water Pollution Control Loan Fund (WPCLF) loan CS392250-01, which is being administered by the Ohio Environmental Protection Agency and the Ohio Water Development Authority.

2. CONSTRUCTION CONTRACT MODIFICATION:
The amount requested under this ordinance is $250,000.00. The contract total including this modification is $ 14,496,400.00. Additional work that is necessary to provide a fully functional facility has been identified that will cost more that the contingency amount incorporated in the contract. Also, there is a potential for additional work items to become necessary during the facility start-up process. The additional funding requested by this ordinance will provide for known costs exceeding the contract contingency amount, estimated costs for other known items, and an amount in reserve for potential additional work items. Due to the complex and comprehensive nature of this project, this additional work could not be foreseen, and it is not practical or feasible to undertake a new procurement to deliver these services.
