BACKGROUND:
This legislation authorizes the Director of Development to enter into a second modification to Contract DL010357 with Burgess and Niple, Inc. by granting a time extension, expanding the scope, and increasing the total contract amount to $530,000. This modification will extend the contract fifteen (15) months to September 30, 2007. It will authorize and fund the preparation and submission of two "No Further Action" letters, per requirements of the Ohio Environmental Protection Agency's, Voluntary Action Program and the completion of engineering documents needed to remediate the recreational portion of the Whittier Peninsula's Southern Tier.
Remediation of the Whittier Peninsula's Southern Tier is a phased project due to facility relocation timelines, site access, development schedules, and funding. Activities to date on this tier have been restricted to property owned by the City of Columbus. It is anticipated that legislation for the demolition of City Recreation and Parks facilities and remediation of the future Audubon leasehold will be submitted in the first quarter of 2007. Additional phases of legislation will be submitted as the project progresses.
FISCAL IMPACT:
The $200,000 will come from the Special Income Tax Fund. This legislation authorizes the appropriation, transfer and the expenditure of funds. This transfer from the Special Income Tax Fund is only a temporary funding measure until bonds are sold in 2006 at which time the Special Income Tax Fund will be reimbursed for this transaction.
