Explanation
1. Background
The D.R. Horton - Indiana by Dave Dozier, Division Vice President of Land Development, owner of the platted land, has submitted the plat titled “Brookview Section 1” to the City Engineer’s Office for review and approval. This plat has been reviewed and approved by the City Engineer. The following ordinance allows the City to accept said plat for property located for a subdivision of lots numbered 1-37, 51-58, 74-82, 93-103 inclusive and reserves “B”, “D”, “E” and “F”.
2. Fiscal Impact
There is no fiscal impact to the City to accept the plat.
3. Emergency Justification
Emergency action is requested to complete the required transfer so that construction may proceed and be completed within the current construction season.

WHEREAS, the plat titled “Brookview Section 1” (hereinafter “plat”) has been submitted to the City Engineer’s Office for approval and acceptance; and
WHEREAS, D.R. Horton - Indiana by Dave Dozier, Division Vice President of Land Development, owner of the platted land, desires to dedicate to the public use all or such parts of the avenues and easements shown on said plat and not heretofore so dedicated; and
WHEREAS, after examination, it has been found to be in the best interest of the City to accept said plat; and
WHEREAS, an emergency exists in the usual daily operation of the Department of Public Service in that said plat should be accepted immediately to allow new development in the area of Brookview Section 1 to proceed as quickly as possible, to ensure the safety of the traveling public thereby preserving the public health, peace, property, safety and welfare; NOW, THEREFORE,
