Explanation
BACKGROUND: This ordinance authorizes a modification to the Water Contract Service to the City of Gahanna by clarifing that, consistent with the other provisions of the contract, Gahanna may enter into contracts with other entities to purchase or take over water lines or mains, and that the Contract remain otherwise unchanged.

To authorize the Director of Public Utilities to enter into a modification of the Water Contracts with the City of Gahanna, Ohio. ($0)
Body
WHEREAS, The City of Columbus and the City of Gahanna have existing Agreements to provide the City of Gahanna with water utility services; and
WHEREAS, the City of Columbus, and the City of Gahanna desire to modify the sevice territory for the Contract; and
WHEREAS, the City of Columbus and the City of Gahanna desire to clarify that, consistent with the other provisions of the contract, Gahanna may enter into contracts with other entities to purchase or take over water lines or mains; and
WHAEREAS, the City of Columbus and the City of Gahanna desire that the Contract remain otherwise unchanged; and
WHEREAS, in the usual daily operation of the Department of Public Utilities, in that it is necessary to authorize the Director of Public Utilities to enter into a modification of the Water Contracts with the City of Gahanna, Ohio for the preservation of public health, peace, property, safety and welfare; Now, Therefore,
BE IT ORDAINED BY THE COUNCIL OF THE CITY OF COLUMBUS:
Section 1. That the Director of Public Utilities be and she is hereby authorized to execute a modification to the Water Contracts with the City of Gahanna, Ohio to include the following Clause in Section 2. "nothing in this Agreement shall be construed to prohibit Gahanna from entering into a contract with another entity to purchase, take over, or connect to water mains and or lines; provided however, that any such mains and or lines be connnected ultima...
