Explanation
BACKGROUND: The Department of Public Utilities would like to enter into the sixth modification of contract EA024824 with Decker Construction Company, for the Utility Cut and Restoration Project, whose focus is to repair damaged items such as pavements, curbs, and sidewalks. The Contract Compliance Number for Decker Construction Company is 31-0983557. They do not have MBE/FBE status.
It is requested that this Ordinance be handled in an emergency manner, as funds in the current contract are almost depleted, and we need to pay current bills.
1. The Division needs an additional $200,000.00. The original contract was established for $350,000.00. The total amount of the original contract and six modifications is $3,420,747.00.
2. The amount of additional funds was foreseen at the time of the original contract. We are just encumbering funds for services for 2004.
3. Work under this modification is a continuation of services performed by the company over the last several years. It would be unreasonable to bid this service out as we have a positive relationship with Decker Construction, who knows our processes and what needs to be done to our satisfaction.
4. Decker Construction is holding over the same prices from modification number four.
FISCAL IMPACT: The Division of Water allocated $640,000.00 in its 2004 Budget for these services.
$ 490,000.00 was encumbered for these services during 2003.
$ 850,000.00 was encumbered for these services during 2002.
