Explanation

BACKGROUND:
This ordinance authorizes the Administrative and Presiding Judge of the Franklin County Municipal Court to enter into the fourth year of a potential four-year contract (pursuant to bid proposal number SA001016) with Netcare Corporation for competency evaluations and examinations of the mental health status of certain defendants that come before the Court.

EMERGENCY: This ordinance is submitted as an emergency to allow the financial transaction to be posted in the city's accounting system as soon as possible. Up-to-date financial posting promotes accurate accounting and financial management.

FISCAL IMPACT: The amount of $70,000 is budgeted and available for this purpose within the Franklin County Municipal Court's 2007 general fund appropriations. This contract term is from April 1, 2007 through March 31, 2008. During 2005, the Court expended $52,080.00 with Netcare. In 2006, a total of $46,600.00 was expended.

Whereas, it is necessary to authorize the Administrative and Presiding Judge to enter into the fourth year of this contract with Netcare Corporation to secure the continued provision of competency evaluations and examinations of each and every affected defendant, and for the protection of their constitutional rights; and

Whereas, funds in the amount of up to $70,000.00 are budgeted and available within the Franklin County Municipal Court's 2007 appropriations for this contract; and
