REZONING APPLICATION: Z07-053

APPLICANT: Joshua Weir; 367 West Third Avenue; Columbus, Ohio 43201.

PROPOSED USE: Single-family and two-family dwelling.

DEVELOPMENT COMMISSION RECOMMENDATION: Approval (5-0) on March 13, 2008.

CITY DEPARTMENTS' RECOMMENDATION: Approval. The 0.28± acre site is zoned in the C-4, Commercial District, and consists of two lots developed with a non-conforming single-family dwelling and a non-conforming two-family dwelling, respectively. The applicant is requesting the R-2F, Residential District for the entire property to make the existing dwellings a conforming use. The Harrison West Plan (2005) recommends neighborhood retail uses for the site. The neighborhood includes a mixture of single-family, two-family and commercial uses. A deviation from the plan is appropriate, in this case, due to the existing dwellings and the mixture of uses in the area. The proposed rezoning is compatible with the zoning and development patterns of the area.

WHEREAS, application #Z07-053 is on file with the Building Services Division of the Department of Development requesting rezoning of 0.28± acres from C-4, Commercial District, to R-2F, Residential District; and

WHEREAS, the Development Commission recommends approval of said zoning change; and

WHEREAS, an emergency exists in the usual daily operation in the City of Columbus in that it is immediately necessary to pass this ordinance due to a need to sell the property and close on a mortgage for the immediate preservation of the public peace, property, health and safety; and
