Explanation

Rezoning Amendment: Z20-104A

Ordinance #1091-2021, passed May 10, 2021 (Z20-104), rezoned 2.04± acres from the M, Manufacturing District to the CPD, Commercial Planned Development District for a mixed-use development in two Subareas (Subarea A and B). That legislation proposed two mixed-use buildings connected with a pedestrian bridge with Subarea A containing a five-story building with 3,500± square feet of commercial space and 143 apartment units, and Subarea B containing a five-story building with 3,950± square feet of commercial space, 53 apartment units, and structured parking with 326 parking spaces. This legislation will amend Ordinance #1091-2021 by modifying the building line in Subarea B from 1-foot to 0.5 feet and to update the site plan to reflect the correct number of units in the development text (196 total apartment units). All other aspects of Ordinance #1091-2021 remain in effect and are included in this amendment.

WHEREAS, Ordinance #1091-2021, passed May 10, 2021 (Z20-104), rezoned 2.04± acres located at 915 W. 5TH AVE. (43212) from the Manufacturing District to the CPD, Commercial Planned Development District; and

WHEREAS, that rezoning established specific development standards addressing number of apartment units, permitted uses, setbacks, access, landscaping, building design, and lighting commitments within the CPD text; and

WHEREAS, the CPD text established a 1-foot building setback in Subarea B; and

WHEREAS, the Applicant proposes to modify the CPD text to establish a 0.5 foot building setback in Subarea B due to site engineering; and
