Explanation
BACKGROUND: This legislation authorizes the Director of Public Utilities to enter into an agreement with the Board of Commissioners of Franklin County, Ohio ("County") and the Village of Lockbourne. The agreement modifies an existing contract between the three parties to provide that the County's sewer assets in the Rickenbacker service area will be transferred to Columbus, and Columbus will provide sewer service to this area. Lockbourne's sewer service is not changed by the modification.
FISCAL IMPACT: There is no impact on the sewer service budget.
Title
To authorize the Director of Public Utilities to enter into a contract modification with the Board of County Commissioners of Franklin County, Ohio ("County") and the Village of Lockbourne to allow the City to provide sewer service to the Rickenbacker service area; and to declare an emergency.
Body
WHEREAS, in 1995, the City, the County and the Village of Lockbourne entered into a contract whereby the County would provide sewer service to certain unincorporated areas around Rickenbacker, as well as to the Village of Lockbourne; and
WHEREAS, in 2003, the City and the County entered into a master agreement for providing sewer service to a number of unincorporated areas in the County; and
WHEREAS, in December 2010, pursuant to Ordinance 1824-2010, passed December 13, 2010, the City and County amended the 2003 sewer agreement, and
WHEREAS, one of the terms of the December 2010 contract concerned modifying the existing three party sewer contract to allow the City to take over responsibility for providing sewer service to the Rickenbacker area from the County, without impact on the Village of Lockbourne; and
WHEREAS, the City, the County and the Village of Lockbourne have agreed on the terms of a contract for the Rickenbacker area, now, therefore,
BE IT ORDAINED BY THE COUNCIL OF THE CITY OF COLUMBUS:
