Explanation
1. BACKGROUND:
This legislation authorizes the Director of Public Utilities to enter into a construction administration and inspection services contract with R. D. Zande & Associates, Inc. The Division of Sewerage and Drainage has reviewed proposals from seven local firms, and is requesting City Council to authorize the award of a contract to the two highest ranking firms.

2. MULTI-YEAR CONTRACT:
This contract establishes fixed direct labor, overhead and fixed fee rates for the period of 2006-2008. This ordinance will authorize the expenditure of $380,145.45 of funds from two recently executed Ohio Water Development Authority (OWDA) Loans for three sanitary sewer projects that are scheduled to commence the during the first quarter of 2006. The Division anticipates requesting additional appropriations to this contract during the remainder of 2006, 2007 and 2008 fiscal years, through plannned contract modifications duly authorized by City Council. These planned modifications will occur as the City acquires funding for the construction contracts through the Ohio Water Development Authority. Under the terms of this contract, the City has the right to contract for additional services to fulfill emergency capital improvements related needs subject to the approval of a contract modification by City Council. The rates schedules established within this contract will remain in force throughout the life of the contract.

3. FISCAL IMPACT:
Funding for this project is derived through the use of construction loans from the OWDA that have been approved by its board. The appropriation of the loan proceeds have been requested and approved within the companion construction contract award legislation (ORD. 0067-2006 and 0059-2006).

4. EMERGENCY DESIGNATION:
