Explanation
This ordinance authorizes the payment of attorney fees to Hunter, Carnahan, Shoub & Byard as legal counsel in the case of Lisa Marie Layman, Administrator of the Estate of Jack Trosper, Plaintiff, v. Lawrence Geis, et al.,United States District Court, Southern District of Ohio, Case No. C2-02-1286.
Fiscal Impact: Sufficient monies have been set aside by the City to pay the amount of this claim.

To authorize and direct the City Auditor to transfer 29,488.00 from the Finance Department to the Department of Public Safety, Division of Police, to authorize and direct the City Attorney to pay attorney fees to Hunter, Carnahan, Shoub & Byard as legal counsel in the case of Lisa Marie Layman, Administrator of the Estate of Jack Trosper, Plaintiff, v. Lawrence Geis, et al., United States District Court, Southern District of Ohio, Case No. C2-02-1286, to authorize the expenditure of the sum of Twenty-nine Thousand, Four Hundred Forty-eight Dollars ($29,448.00), and to declare an emergency.
Body
WHEREAS, Lisa Marie Layman, Administrator, filed suit against Office Lawrence Geis and the City of Columbus in case No. C2-02-1286; and,
WHEREAS, since there existed a conflict of interest between Officer Geis and the City of Columbus, it was necessary to employ counsel to defend the interest of Officer Geis; and,
WHEREAS, the lawsuit has now been dismissed against the City of Columbus and Officer Geis; and,
WHEREAS, the law firm of Hunter, Carnahan, Shoub & Byard has now submitted a statement for professional services rendered in the amount of Twenty-nine Thousand, Four Hundred Forty-eight Dollars ($29,448.00); and,
WHEREAS, funds are available within the Finance Department to transfer for this purpose: and,
WHEREAS, by reason of the foregoing, an emergency exists in the usual daily operations of the City of Columbus in that it is immediately necessary to pay legal counsel in a timely fashion thereby preserving the public peace,...
