Explanation
BACKGROUND: In the course of effecting roadway improvements, it is sometimes necessary to force the relocation of utilities from privately held easements. This relocation expense is a liability to the city. Utility relocation estimates are normally included in the budget for each project, but frequently these estimates prove insufficient for a variety of reasons, few of which the city can control. Over the course of several years, the Transportation Division (or its predecessor divisions) has accumulated utility relocation expenses that have not yet been reimbursed to ACO Pipeline. This ordinance provides for reimbursement to ACO Pipeline for the Sancus Boulevard project in the amount of $66,126.06.
FISCAL IMPACT: Money needed for this utility relocation for the Sancus Boulevard construction project is available within the 1995, 1999 Voted Streets and Highways Fund.
Emergency action is requested to expedite payment of this liability.

To authorize the Public Service Director to reimburse $66,126.06 or so much thereof as may be needed to ACO Pipeline for utility relocation expenses related to the Sancus Road construction project for the Transportation Division, to authorize the expenditure of these funds from the 1995, 1999 Voted Streets and Highways Fund, and to declare an emergency. WHEREAS, the Transportation Division has incurred expenses in connection with roadway improvement-related utility relocations, and
WHEREAS, these costs must be reimbursed to ACO Pipeline, and
WHEREAS, funds are available in the 1995, 1999 Voted Streets and Highways Fund, and
WHEREAS, an emergency exists in the usual daily operation of the Transportation Division, Public Service Department, in that it is immediately necessary to make payment to ACO Pipeline for utility relocation expenses on the Sancus Boulevard construction project, thereby preserving the public health, peace, property, safety and welfare...
