Title: To authorize the Director of Public Utilities to enter into a construction contract with Darby Creek Excavating, Inc. for the West Broad Street 12" Water Line Improvements Project; to amend the 2012 Capital Improvements Budget; to authorize a transfer and expenditure up to $166,845.97 from the Water Works Enlargement Voted Bonds Fund; for the Division of Power and Water; and to declare an emergency. Explanation

1. BACKGROUND: This legislation authorizes the Director of Public Utilities to enter into a construction contract with Darby Creek Excavating, Inc. in the amount of $166,845.97, for the West Broad Street 12" Water Line Improvements Project, Division of Power and Water Contract Number 2005.

This project consists of installing approximately 900 linear feet of 12-inch water line and appurtenances.

2. ECONOMIC IMPACT/ADVANTAGES; COMMUNITY OUTREACH; PROJECT DEVELOPMENT; ENVIRONMENTAL FACTORS/ADVANTAGES OF PROJECT: This project is required due to the ODOT roadway improvement project. The ODOT project is installing storm sewers for additional drainage that impact the existing water main along West Broad Street. The proposed main will eliminate this conflict with the ODOT project. Throughout the design phase of the project, the DOPW coordinated with ODOT, the Franklin County Engineer's Office, and the property owners in the area. During construction the contractor and the DOPW Project Manager will coordinate with the area businesses to perform the necessary work and maintain water service.

3. CONSTRUCTION CONTRACT AWARD: The Director of Public Utilities publicly opened five bids on June 27, 2012 from: Darby Creek Excavating, Inc. - $166,845.97; Danbert, Inc. - $216,680.20; Shelly & Sands, Inc. - $224,361.50; Conie Construction Co. - $237,600.00; and Columbus Asphalt Paving - $294,170.80.

Darby Creek Excavating, Inc.'s bid was deemed the lowest, most responsive and responsible bid in the amount of $166,845.97. Their Contract Compliance Number is 31-1345111 (expires 2/16/14, Majority). Additional information regarding each bidder, description of work, contract time frame and detailed amount can be found on the attached Information form.

Searches in the Excluded Party List System (Federal) and the Findings for Recovery list (State) produced no findings against Darby Creek Excavating, Inc.
