Explanation
Background: Approval of ordinance 2807- 97 on November 24, 1997, authorized the Franklin County Municipal Court Clerk to enter into a contract with Maximus, Inc. formerly known as Crawford Consulting, Inc. for the installation of CourtView 2000, the Franklin County Municipal Court Clerk case management system. The proprietary ownership by Maximus. Inc. of the CourtView 2000 software is addressed in contract number 18848. The software and all copies are proprietary to Maximus.
The Franklin County Municipal Court Clerk negotiated a new maintenance and support contract with Maximus, Inc., the sole source provider of said services for the Municipal Court Clerk case management system. Due to the timeliness and complexity of the negotiations, the contract was not negotiated before the last council meeting before the summer recess. Therefore, on August 8, 2007 a Mayor's emergency was declared authorizing contract # EA006734 for the first five (5) months of a twenty nine (29) month contract with Maximus, Inc. commencing August 1, 2007 through December 31, 2007 for the provision of software maintenance and support, and optional fees.
This ordinance authorizes a supplemental appropriation of $262,960.00 from the unappropriated balance of the Franklin County Municipal Court Clerk computer fund; authorizes and directs the Franklin County Municipal Court Clerk to enter into the next twelve (12) months of a twenty nine (29) consecutive month contract with Maximus, Inc. commencing January 1, 2008 through December 31, 2008 to be paid on a quarterly basis for the provision of software support in the amount of $237,960.00 and optional services in the amount of $25,000.00 for the Municipal Court Clerk case management system. The optional services are for monies needed in the event that additional services are required for the case management system.
