Explanation
The following is a resolution to declare the necessity and intent to appropriate fee simple title and lesser interests in and to real estate in connection with the Parsons/Livingston Avenue Roadway Improvement Project.
Fiscal Impact:
N/A
Emergency Justification: This project has been identified to receive funding for construction as part of the American Recovery and Reinvestment Act of 2009. Failure to complete right-of-way acquisition in a timely manner may result in the loss of the Federal stimulus dollars. Emergency action is requested to allow right-of-way acquisition to remain on schedule.
Title
To declare the necessity and intent to appropriate fee simple title and lesser interests in and to real estate in connection with the Parsons/Livingston Avenue Roadway Improvement Project, and to declare an emergency.
Body
WHEREAS, the City of Columbus is engaged in the Parsons/Livingston Avenue Roadway Improvement Project; and
WHEREAS, an emergency exists in the usual daily operation of the Department of Public Service, Division of Design and Construction, in that it is necessary to appropriate such real property interests so that there will be no delay in the aforementioned project, and for the immediate preservation of the public peace, property, health and safety; now, therefore:
BE IT RESOLVED BY THE COUNCIL OF THE CITY OF COLUMBUS:
Section 1. That this Council hereby declares the necessity and intent to appropriate fee simple title and lesser interests in and to the following described real estate necessary for the Parsons/Livingston Avenue Roadway Improvement Project, Project #530161, pursuant to and in accordance with the Charter of the City of Columbus, Columbus City Code (1959) Revised, Chapter 909, the Constitution of the State of Ohio and Ohio Revised Code, Chapter 719; to-wit:
