Explanation
BACKGROUND: For the option to purchase Powdered Activated Carbon for the Water Division, Department of Public Utilities. The term of the proposed option contracts would be through March 31, 2009. The Purchasing Office opened formal bids on January 5, 2006.
The Purchasing Office advertised and solicited competitive bids in accordance with Section 329.06 (Solicitation No. SA001864). Ninety seven bids were solicited (MAJ:95, MBE:2); Sixteen bids were received from ten (MAJ:10) bidders.
The Purchasing Office is recommending award of one primary contract to the lowest, responsive, responsible and best bidder and a secondary award (per Ohio EPA requirement) to the next lowest, responsive, responsible and best bidder:
Envirotrol, Inc.; CC# 251209145, Primary award, all items
Jacobi Carbons Inc., CC#233094148, Secondary award, all items.
Total Estimated Annual Expenditure: $1,289,600.00
These Companies are not debarred according to the Excluded Parties listing of the Federal Government and are not listed in the Auditor of State's database for Findings for Recovery.
This ordinance is being submitted as an emergency because, without emergency action, no less than 37 days will be added to this procurement cycle and the efficient delivery of valuable public services will be slowed.
FISCAL IMPACT: Funding to establish this option contract is budgeted in the Purchasing Contract Account. City Agencies will be required to obtain approval to expend from their own appropriations for their estimated annual expenditures.

To authorize and direct the Finance and Management Director to enter into a UTC contract for the option to purchase Powdered Activated Carbon with Envirotrol, Inc. and Jacobi Carbons Inc.to authorize the expenditure of two dollars to establish the contract from the Purchasing Contract Operation Fund, and to declare an emergency.
