Explanation
Background: The City of Columbus, Ohio (the "City") is owner of certain communications tower sites, which are located on those City properties known as the Morse Road Water Treatment Plant and The Parsons Avenue Water Treatment Plant respectively. The State Of Ohio, Department of Administrative Services, Multi-Agency Radio Communication System Office, ("MARCS") desires to utilize the two separate City owned communications towers for the purpose of operating a mobile radio system. This system allows radio communication among and between several State agencies, including the Ohio State Highway Patrol. MARCS desires to access certain portion of the two premises for the installation of certain communication equipment necessary to its operation. After investigation, it has been determined that granting MARCS the use of the tower sites will not adversely effect the City. The following ordinance authorizes the Director of the Department of Public Utilities to execute those separate documents necessary to grant the State Of Ohio, Department of Administrative Services licenses for use of the aforementioned communication tower sites.
Fiscal Impact: Any revenues generated by this transaction and received by the City in the appropriate fund as set forth in the body of this legislation.
Emergency Justification: Emergency action is requested to allow for the City's immediate collection of revenues generated from the granting of the subject license agreements.

To authorize the Director of the Department of Public Utilities to execute those documents necessary to grant the State Of Ohio, Department of Administrative Services, Multi-Agency Radio Communication System Office, separate licenses for the shared utilization of two City owned communications towers for the purposes of operating a multi-state agency mobile radio system, and to declare an emergency.
