Explanation

Background: This legislation authorizes the Public Service Director to modify and increase the Transportation Division's engineering services contract with M-E Companies for the Henderson Road Improvement Project. The contract modification is necessary as the Division of Power and Water (Water) requested the design of an 8" water line from High Street to the Olentangy River along Henderson Road. Since the Transportation Division's original contract involves tearing up the road, it is logical to replace aging water lines now rather than tearing up the same road in the future. This saves not only time and cost, but an inconvenience to roadway traffic.

1. Amount of additional funds to be expended: $43,204.53

Original Contract Amount: $306,918.00

Modification #1: $ 63,601.51
Modification #2: $ 157,534.95
Modification #3 (current) $ 43,204.53
$ 264,340.99

The amount of the original contract and all modifications is: $571,258.99

2. Reasons additional goods/services could not be foreseen:
The need for additional services was foreseen. The project has been on-going since 2000, but it was not known what year funds would be needed.

3. Reason other procurement processes are not used:
This project is a continuation of the existing work being performed and it would not be practical to contract with a different consultant. There are significant time and cost savings by having the same company perform the work.

4. How cost of modification was determined:
New hourly rates, overhead rate, and percentage of profit were provided by M-E Companies via letter dated April 11, 2007. These rates were negotiated between M-E and the City.

M-E Companies (C.C.# 31-1442777, expires 2/18/08, majority) was selected in accordance with Chapter 329 for professional service contracts.
