Explanation
BACKGROUND: This legislation will enable the Department of Public Utilities, Division of Power and Water, to proceed with the installation of a high pressure sodium street lighting system for Miami Avenue under the assessment procedure.
Emergency action is requested to respond to a citizens' approved petition and for a timely implementation of construction services.
FISCAL IMPACT: The entire cost of this project shall be assessed to the property owners.

To authorize the Department of Public Utilities, Division of Power and Water, to proceed with the installation of a high pressure sodium street lighting system with ornamental poles and underground wiring for Miami Avenue under the assessment procedure, and to declare an emergency.
Body
WHEREAS, it is necessary to proceed with the installation of a high pressure sodium street lighting system with ornamental poles and underground wiring for Miami Avenue; and
WHEREAS, a Board of Revision appointed and acting in the pursuance of Resolution 0223X-2007, adopted by City Council on December 10, 2007, respectfully approved the estimated assessment for the cost and expense of the improvement; and
WHEREAS, emergency action is necessary to avoid any further delay in the implementation of construction services in accordance with citizens' approved petition for street lighting under the assessment procedure; and
WHEREAS, an emergency exists in the usual daily operation of the Department of Public Utilities, Division of Power and Water, in that it is immediately necessary to proceed with the installation of street lighting improvements for Miami Avenue for the immediate preservation of the public health, peace, property, safety and welfare; now, therefore,
