Title: To authorize the expenditure of $325,000.00 or so much thereof as may be necessary to allow the City Attorney's Office, Real Estate Division, to complete acquisition of the rights-of-way needed for the River South Phase 2 Improvement Project from the Streets and Highways G.O. Bonds Fund; to amend the 2008 CIB; to authorize the appropriation and transfer of funds within the Streets and Highways G.O. Bonds Fund; and to declare an emergency. ($325,000.00)
Explanation

1. BACKGROUND
The City of Columbus, Department of Public Service, Division of Design and Construction, is engaged in the River South, Phase 2 Improvements Project. The purpose of this project is to reconstruct 0.21 miles of Front Street between Mound Street and Rich Street; reconstruct 0.20 miles of Rich Street between Civic Center Drive and High Street; reconstruct 0.23 miles of Main Street between Second Street and High Street and widen and resurface 0.11 miles of Main Street between Second Street and Civic Center Drive. Improvements within the project limits include upgraded sidewalks with pedestrian crossing upgrades at intersections, landscaping, storm sewers, water lines, street lighting, and traffic control devises. The City is currently finalizing construction plans and is actively involved in right-of-way acquisition associated with this project. Ordinance 1533-2008 (AC 029077) authorized the City Attorney's office, Real Estate Division, to expend $100,000.00 for acquisition of miscellaneous parcels of permanent and temporary right-of-way needed for projects throughout the City. Title work and preliminary appraisal work associated with this project are complete. It is now necessary to authorize the City Attorney's Real Estate Division staff to expend an additional $325,000.00 for land acquisition and other costs associated with the acquisition of the rights-of-way needed for this project.

2. Fiscal Impact
Monies to pay for these costs are available within the Streets and Highways G.O. Bonds Fund due to cancellation of encumbrances from completed projects.

3. Emergency Justification
This project has been identified as a Federal stimulus package project. Failure to complete right-of-way acquisition may jeopardize the city's ability to fulfill the project scheduling requirements of the stimulus funding.
