Rezoning Application Z04-088

APPLICANT: Three Rocks, LLC; c/o Jeffrey L. Brown, Atty.; Smith and Hale; 37 West Broad Street,
Suite 725; Columbus, OH 43215.

PROPOSED USE: Single-family residential development.

DEVELOPMENT COMMISSION RECOMMENDATION: Approval (4-0-1) on March 10, 2005.

CITY DEPARTMENTS' RECOMMENDATION: Approval. The Applicant is requesting the PUD-4, Planned Unit Development District to develop a maximum of 48 detached single-family dwellings on private streets with a proposed density of 2.94 units per acre. The PUD plan and notes include 1.56± acres of open space and a conservation easement to protect Hayden Run, provide customary development standards, and commit to a 25-foot tree preservation area along the east, south, and west property lines. The requested PUD-4, Planned Unit Development District is consistent with the zoning and development patterns of the area.

WHEREAS, application #Z04-088 is on file with the Building Services Division of the Department of Development requesting rezoning of 16.30± acres from R, Rural District, to the PUD-4, Planned Development District; and

WHEREAS, the Development Commission recommends approval of said zoning change; and

WHEREAS, an emergency exists in the usual daily operation in the City of Columbus in that it is immediately necessary to pass this ordinance to begin construction as soon as possible for the immediate preservation of the public peace, property, health and safety; and
