Title: To authorize the Director of the Department of Public Utilities to enter into a contract with the Columbus and Franklin County Metropolitan Park District to sell certain City-owned properties on Amity Road in Franklin County, to waive the competitive bidding and Land Review Commission provisions of Columbus City Codes.
Explanation

Background: In the late 1960's and early 1970's the Division of Water purchased certain properties on Amity Road for use as part of a dam planned on Big Darby Creek as an addition to the City's water supply. By court order issued in a case entitled Columbus v. Teater, 53 Ohio St. 2d 253, the City was enjoined from constructing a dam on Big Darby Creek. Consequently, these properties became excess properties no longer needed by the Division of Water. In 1998 the Columbus and Franklin County Metropolitan Park District approached the Division of Water to purchase these excess properties as part of their plan to protect the Big Darby watershed. Because of quarrying operations, two of the parcels were held back from sale until the quarrying was completed. The Land Review Commission recommended the sale to Metropolitan Parks and the City passed Ordinance 3223-98, passed December 07, 1998, authorizing the sale of all the properties except for the parcels being quarried. The Columbus and Franklin County Metropolitan Park District now desires to purchase the remaining parcels. Metro Parks has agreed to purchase the properties for the value determined by an appraisal obtained by the City.Fiscal Impact: N/AEmergency Justification: N/A
