Explanation
1. Background
The City of Columbus, Department of Public Service, received a request from the property owner, McNaughten Road Real Estate Project, asking that the City allow a retaining wall approximately four feet in height, and fencing installed on top of the retaining wall approximately five feet in height, to encroach into the public right-of-way. This encroachment is for their project located along the west side of McNaughten Road just north of Baskerville Drive as designed in the approved plans known as Improvements of McNaughten Road. These plans were filed at the City of Columbus Engineer's Office under 3625 Drawer E plan.

This project will install a right-in/right-out driveway for McNaughton Road and a five foot long public sidewalk along McNaughton Road. The encroachment will consist of a wall and fencing along the sidewalk. The sidewalk is to be built over a culvert with a stream, and the wall and fencing is to protect the public by preventing falls into the culvert. They will protrude into the public right-of-way as described below, as shown on the attached exhibit, and within the approved 3625 Drawer E plan. The following legislation authorizes the Director of the Department of Public Service to execute those documents necessary for the City to grant these encroachments to legally allow the wall and fencing to extend into the public rights-of-way. Installation of these elements will provide safety to anyone using the public sidewalk. A value of $500.00 for the encroachment easement was established.

2. Fiscal Impact
The City will receive a total of $500.00, to be deposited in Fund 7748, Project P537650, for granting the requested encroachment.
